These Terms of Service govern your access to and use of Articulics and set out the rules, subscription terms, and legal conditions that apply to the service.

These Terms of Service (“Terms”) govern your access to and use of the Articulics website, apps, and related services (the “Services”). By accessing or using the Services, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

1. Who We Are

Articulics ("Articulics," "we," "us," or "our") provides online pronunciation learning, speech practice, and feedback tools.

2. Eligibility and Service Region

The Services are intended for users in Canada and the United States.

You may use the Services only if you can form a legally binding agreement under applicable law.

If you are under 13, a parent or legal guardian must create, authorize, and manage your account on your behalf. By creating or managing a child account, the parent or legal guardian agrees to these Terms for themselves and for the child, and represents that they have authority to do so.

3. Accounts

  • You are responsible for providing accurate account information.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You may not share your account in a way that violates these Terms or compromises account security.
  • We may suspend or terminate accounts that are fraudulent, abusive, unlawful, or in violation of these Terms.

4. Child Accounts

  • For users under 13, a parent or legal guardian must create or authorize the account.
  • The parent or legal guardian is responsible for the account and the child’s use of the Services.
  • The parent or legal guardian may request access to or deletion of the child’s information, subject to our Privacy Policy and applicable law.

5. The Services

Articulics provides educational pronunciation feedback, practice tools, quizzes, calibration tools, progress tracking, and related features.

We may add, remove, modify, or discontinue features at any time.

We do not guarantee that any feature will always be available, uninterrupted, error-free, or suitable for every learner.

6. Educational Use Only

The Services are provided for educational and informational purposes only.

Articulics is not a medical provider, speech-language pathology clinic, or emergency service. The Services are not a substitute for professional medical, therapeutic, educational, or clinical advice, diagnosis, or treatment.

7. AI-Assisted Feedback

Some feedback, summaries, or coaching may be generated or supported by automated systems and AI tools.

  • Results may not always be complete, accurate, or appropriate for every situation.
  • Users should not rely on the Services as the sole basis for important educational, medical, therapeutic, or legal decisions.

8. User Content

You may submit audio recordings, words, prompts, transcripts, and other content ("User Content") through the Services.

You retain ownership of your User Content.

You grant Articulics a limited, non-exclusive, revocable license to host, process, analyze, store, reproduce, and use User Content as necessary to operate, maintain, secure, and improve the Services in accordance with these Terms and the Privacy Policy.

We do not use children’s data for training or improvement purposes.

9. Acceptable Use

  • Do not use the Services for unlawful, abusive, deceptive, or fraudulent purposes.
  • Do not impersonate another person or misrepresent your identity.
  • Do not upload content you do not have the right to use, including copyrighted recordings, unlawful content, or voice recordings or voice clones of another person without their authorization.
  • Do not attempt to interfere with the operation or security of the Services.
  • Do not scrape, crawl, reverse engineer, or extract source code except where prohibited by law from restricting such rights.
  • Do not upload malicious code or harmful material.
  • Do not use the Services in a way that infringes another person’s rights.
  • Do not use the Services to build a competing product by systematically extracting data or outputs.

10. Subscriptions, Billing, and Renewal

Some features may require a paid subscription.

If you purchase a subscription, you agree to pay the listed price and applicable taxes, subscriptions may be offered on a monthly or annual basis, subscriptions automatically renew unless canceled before the next renewal date, and you authorize recurring charges using your selected payment method.

Prices, plans, and features may change from time to time. If we change pricing for an existing subscription, we will provide advance notice where required by law.

You are responsible for keeping your payment information current.

11. Cancellation and Refunds

You may cancel your subscription at any time.

Unless otherwise stated at purchase, cancellation stops future renewals, your access continues until the end of the current billing period, and payments already made are non-refundable except where required by applicable law.

We do not currently offer free trials.

12. Payment Processing

Payment processing may be handled by third-party providers such as Stripe. We do not control those processors’ independent terms, privacy practices, or technical operations.

Your use of third-party payment services may also be subject to their terms and policies.

13. Intellectual Property

The Services, including our software, branding, design, text, graphics, interfaces, and non-user content, are owned by Articulics or its licensors and are protected by intellectual property laws.

Except for the limited rights granted in these Terms, you receive no ownership or license rights in the Services.

14. Feedback

If you provide suggestions, ideas, or feedback about the Services, we may use them without restriction or compensation to you.

15. Suspension and Termination

We may suspend or terminate your access to the Services if you violate these Terms, we reasonably believe your use creates legal, security, or operational risk, we are required to do so by law, or we discontinue the Services.

You may stop using the Services at any time.

Sections that by their nature should survive termination will survive, including those relating to payment obligations, intellectual property, disclaimers, limitation of liability, disputes, and governing law.

16. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

  • To the maximum extent permitted by law, Articulics disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • We do not guarantee that the Services will be uninterrupted or error-free.
  • We do not guarantee that feedback will always be accurate or useful.
  • We do not guarantee that the Services will produce any particular learning result or outcome.

17. Limitation of Liability

To the maximum extent permitted by law, Articulics and its affiliates, officers, directors, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Services or these Terms.

To the maximum extent permitted by law, Articulics’ total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid to Articulics in the 12 months before the claim or CAD $100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Articulics and its affiliates, officers, directors, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising out of your use of the Services, your User Content, your violation of these Terms, or your violation of another person’s rights.

If you are a parent or legal guardian managing a child account, this also applies to the child’s use of the Services.

19. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of law principles.

Unless applicable law requires otherwise, you agree that disputes arising out of or relating to these Terms or the Services will be resolved exclusively in the courts located in British Columbia, Canada.

If you are a consumer, you may also have mandatory rights under the laws of your home jurisdiction that cannot be waived by these Terms.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new Last updated date and may provide additional notice where appropriate.

Your continued use of the Services after the updated Terms take effect means you accept the revised Terms.
